John Anthony Castro warned Trump he will unleash legal hell on him and said he will not rest until the former president is behind bars.

The Texas lawyer and politician has long been a Trump critic, and now he wants to take him off the ballot.

The lawyer initially wrote, "Happy Labor Day! About to unleash legal hell on @realDonaldTrump in what he thought was secure red states… but they're in blue circuits. Zero path to 270."

He had more to say

Castro further said on X, "Make no mistake: I will end Trump’s political career."

A "Hail Mary" for Trump's opponents

Former federal prosecutor Neama Rahmani told Newsweek that Castro's attempts to have Trump disqualified are a "long shot" but may be "worth a 'Hail Mary' for Trump opponents.

The prosecutor explains why Castro might fail

"The reasons why Castro's efforts probably won't succeed are that Trump hasn't been charged with, much less convicted of, insurrection or rebellion. A conviction is not required under the plain language of the Constitution. Still, it's telling that even those prosecuting Trump don't believe that there is enough evidence to convict him or insurrection or sedition," Rahmani added.

The lawyer and politician spoke to Newsweek and wondered, "The fact that all the Trump cases keep getting assigned to Judge Cannon cannot be a coincidence. I'm a math person, and so I can just tell you like the Vegas odds of this are through the roof. You know what I mean? That's like lightning striking in the same place five times."

Lawrence Caplan, a Florida tax attorney, and two others filed the suit claiming that Trump must be removed from the ballot due to his alleged role in the Capitol riot. It was dismissed by Judge Robin Rosenberg, appointed by Obama in 2014. The reasons for dismissal might go in Castro's favor.

Rosenberg's ruling

"An individual citizen does not have standing to challenge whether another individual's qualified to hold public office," wrote the Judge. However, with Castro being a GOP presidential hopeful, the ruling that the lawsuit lacked standing since "the injuries alleged" in the filing were not "cognizable" nor "particular" to the plaintiffs might not stand.

Castro filed in Wyoming, Utah, Oklahoma, North Carolina, West Virginia, Montana, Kansas, and Idaho. Newsweek explained, "Analysts only view North Carolina as being competitive in the 2024 election, but Trump not having access to any of these ballots would complicate his path to winning the Electoral College."

Also on X, the lawyer from Texas added, "You think this intimidates us, @realDonaldTrump? Think again. We're not gonna rest until you’re behind bars; caged like the uncivilized animal that you are."

Insurrection or not?

The New York Times wrote, “While many people have called the events of January 6 an ‘insurrection,’ the Justice Department has not charged any rioters with that crime.”

The likely way to keep Trump off the ballot is if he gets convicted in the Georgia or DC cases. Sen. Tim Kaine said, "There's a powerful argument to be made” regarding the 14th amendment, section 3, but it might not be enough. Yet.
