A non-binary 17-year-old can remove their breasts, the High Court in London ruled, after parents tried to stop the teen from the surgery.
The court first heard from the teen
The non-binary teen, who is a lesbian, said they found their identity when they were 11 but did not tell the parents who claimed the LGBTQ community was " evil and satanic," the Guardian reported.
The teen's testimony
The teen told the court, "I was being emotionally abused by my parents constantly because they would almost make comments to me about how identifying as transgender means I am mentally ill. They would constantly make homophobic/transphobic comments towards me and say things such as the reason LGBTQ+ is normal in the UK is because they are trying to reduce the population."
The parents claimed the teen experienced psychotic episodes
The teen's parents moved to the UK 14 years ago. They presented a report in their native language showing the child suffers a schizotypal personality disorder. They also claimed the teen experienced psychotic episodes and is bipolar. But, social workers claimed that the teen, known as EE, was bright, had good friendships, and had excellent grades.
The teen wants a bilateral mastectomy
EE said their life would be starting after the mastectomy. Their lawyers accused the parents of being "oppressive" and attempting to find an expert who would support their "fixed belief" that their child was ill. Mr Justice Macdonald, in a ruling, said the parents made homophobic remarks and saw teen's piercings as self-harm.
The Judge saw no proof the teen had a mental illness
Despite parent's protest and claims the teen does not understand gender-affirming care, Macdonald did not see any signs of mental illness. Furthermore, Justice said EE was forced to take part in some sort of conversion therapy, which is not legal in the UK. According to court documents, the teen ran away from home a few months after this therapy took place.
The Judge also made a valid point
The Judge refused to grant the injunction, in part, saying that the 17-year-old would soon be a legal adult. The ruling also says the teenager should be notified about their options and the proceedings.
